Privacy Policy

Intro

This binding agreement between the user (the browser or subscriber to the services) and Uhouzez (registered under the laws of the State of Kuwait) governs the use of the Uhouzez electronic platform for real estate trading. This agreement is subject to the applicable laws of the State of Kuwait, and users are requested to read it carefully before use.

Compliance with Local Laws

  • Users must comply with the Kuwaiti Real Estate Law (Law No. 5 of 2016), the Personal Data Protection Law (Decree No. 71 of 2019), and all related regulations.
  • Posting real estate advertisements without verifying property ownership and ensuring compliance with the necessary licenses from the Ministry of Housing or the relevant authorities is prohibited.

Registration and Use

  • Registration requires creating a personal account using accurate and up-to-date information, with the user acknowledging that they are over 21 years old or have legal authorization.
  • The use of an account for illegal purposes, including fraud or price manipulation, is prohibited.
  • Uhouzez reserves the right to suspend or terminate any account that violates the terms without compensation.

Content

  • The user is responsible for all content they publish (photos, descriptions, videos), which must be free from any material that violates morals or laws.
  • Uhouzez has the right to delete or modify any content deemed non-compliant with legal standards or internal policies without prior notice.
  • All content is subject to verification by Uhouzez before publication to ensure accuracy and compliance with laws.
  • Posting advertisements containing misleading information regarding prices, sizes, or property condition is prohibited and may result in legal liability.
  • Using the platform’s content to promote non-real estate products or services without prior approval from Uhouzez is prohibited.
  • The user is responsible for any reviews or comments they post, which must be genuine, non-offensive, and in compliance with the Cybercrime Law (Law No. 63 of 2015).
  • Publishing content that includes inflammatory language, racism, sensitive religious topics, or material that contradicts Kuwaiti cultural values is prohibited.
  • Photos must be free from unrealistic or misleading edits, and must accurately reflect the property’s condition.
  • Uhouzez has the right to retain copies of published content for legal auditing purposes while maintaining data confidentiality as per the law.

Data Protection

  • User data (name, address, phone number, email) is collected in accordance with the Personal Data Protection Law (Decree No. 71 of 2019) and stored securely using approved encryption technologies.
  • Data may be shared with official authorities upon legal request or with trusted partners to provide services, while maintaining confidentiality according to internal policy.
  • Users have the right to request access to, modification, or deletion of their data by contacting technical support within 30 days of the request.
  • In case of a data breach, Uhouzez will notify affected users and the Kuwaiti Data Protection Authority within 72 hours of discovery.
  • Personal data will be retained for no longer than 5 years from the last interaction or as required by law, after which it will be securely deleted.
  • Exporting user data outside Kuwait without prior approval from the relevant regulatory authorities is prohibited.
  • Users must report any potential data privacy violations via the platform within 48 hours of discovery.
  • Additional security measures such as two-factor authentication are applied for access to sensitive accounts, and users must protect their passwords.

Legal Liability

  • Uhouzez provides services “as is” without express or implied warranties and is not liable for indirect damages resulting from use, including financial losses or transaction delays.
  • The user is fully legally responsible for any contracts or transactions made through the platform and must register them with the relevant authorities according to Kuwaiti real estate law.
  • Uhouzez’s liability is limited to the amount of fees paid by the user in the year prior to the damage, in cases where direct fault by the platform is proven.
  • If the user breaches the agreement (such as providing misleading information), they must compensate Uhouzez for any losses or legal costs incurred, including legal fees.
  • Uhouzez is not responsible for technical errors caused by external systems (such as internet providers) or misuse of the platform by the user.
  • Uhouzez is exempt from liability in the event of a cyberattack or breach that exceeds adopted security measures, provided that authorities are notified immediately.
  • The user is responsible for any law violations arising from the use of the platform, including paying fines or compensation imposed by official authorities.

Real Estate Services

  • Uhouzez provides a platform for displaying properties and facilitating communication between buyers and sellers, without being a party to the contracts.
  • Users must verify the accuracy of property information (documents, ownership, licenses) before entering into any transaction.

Payment and Fees

  • Fees may apply to specific services such as featured ad promotions, 3D virtual tours, and market analytics, and must be paid through approved channels (such as bank transfer or credit cards accepted in Kuwait).
  • Fees are determined based on the service type and listed on the paid services page, which may be updated periodically with prior notice to users.
  • Fees must be paid in advance to activate paid services. Fees are non-refundable if the service is canceled by the user, except in cases of proven technical error by Uhouzez.
  • A refund policy allows requesting a refund within 7 days of payment if the service was not delivered, with an administrative deduction not exceeding 10% of the paid amount.
  • Monthly or annual subscription options are available for paid services, with the user committing to periodic payment as scheduled. Subscriptions may be canceled with 15 days’ written notice.
  • Uhouzez may offer promotional deals or discounts on paid services, which are subject to announced terms and are non-transferable and non-refundable in cash.
  • All transactions are subject to Kuwaiti tax laws, and users must provide official invoices upon request. Uhouzez will issue an electronic invoice for each payment.
  • Uhouzez is not responsible for payment errors resulting from incorrect information provided by the user or payment delays caused by external payment systems.

Intellectual Property Rights

  • Uhouzez retains intellectual property rights to all designs, logos, text, software, and content provided by the platform, in accordance with the Intellectual Property Protection Law (Law No. 64 of 2015).
  • Copying, distributing, modifying, or reusing any content or trademark belonging to Uhouzez without prior written and certified approval is prohibited.
  • Uhouzez retains the rights to the “Uhouzez” trademark and all related logos, and their use in commercial or misleading contexts without permission is prohibited.
  • Users are allowed to use content licensed by Uhouzez (such as templates or images) only within the scope of the provided services, with proper attribution to the source.
  • In case of an intellectual property rights violation, the user must notify Uhouzez immediately via email with evidence, and Uhouzez reserves the right to take appropriate legal action.
  • Users retain intellectual property rights to the content they publish (such as property images), but grant Uhouzez a non-exclusive license to use it within the platform for display and promotional purposes.
  • Using automated extraction technologies (such as bots) to obtain content or trademarks from the platform without prior approval is prohibited.

Termination of Service

  • Uhouzez may immediately terminate user services in the event of a breach of terms or laws.
  • Users may terminate their accounts with prior written notice, ensuring all financial obligations are settled.

Amicable Settlement and Arbitration

  • In case of a dispute, the parties should attempt amicable settlement within 30 days of notification.
  • If settlement fails, the dispute shall be subject to arbitration in the State of Kuwait under the Arbitration Law (Law No. 11 of 1995) with neutral arbitrators.
  • Civil courts in the Capital Governorate of Kuwait have primary jurisdiction if arbitration is refused.

Modifications and Notifications

  • Uhouzez reserves the right to amend these terms with at least 15 days’ prior notice to users via the platform or email.
  • Continued use of the site after amendments constitutes implied acceptance of the new terms.

Force Majeure

  • Uhouzez is not liable for delays or failures in service delivery due to force majeure events (such as wars, natural disasters, or internet outages).
  • Any force majeure situation will be announced to users immediately.
